Having the courage to turn down an average settlement offer when you have a really great client with a great story and bad injuries, knowing you may have to just try the case, is a scary but good feeling. We shouldn’t be scared to try cases. Otherwise we’re just bluffing.

I agree. I think it’s normal to have a little fear and some anxiety or anxiousness, but turn that into a positive energy and enjoy the journey. Trial prep in and of itself is a lot of work and requires perseverance and diligence and for sure and extreme focus on details. As a Litigation Paralegal who has worked for some smart, strategic, charismatic and hardworking attorneys who embrace the challenges of trial work, I learned to be the one taught and mentored to say, “can we please stipulate to the trial calendar?”..Lol …I often see attorneys who are afraid to go to trial, and do whatever they can to avoid trial, but yet they call themselves litigation attorneys, or trial attorneys; who are they fooling?

I can’t speak to trials as I haven’t gone through one yet, but litigation can definitely be nerve wracking. You’re absolutely right though; we’re doing our clients a disservice if we take a settlement just based on our fear of trying a case.

So many love it, but our pay is low compared to the rest of the financial sector, and so when people with great experience come knocking, HR denies them because the ask is outside the price range. For Plaintiff's attorneys, how big is your caseload? What kind of cases are the majority of them and are they in suit? I am currently handling 150+ mostly MVAs and premise liability cases, just about all in suit, (on top of about 10 DUIs and other small traffic matters) and I feel like I'm drowning and looking to jump ship. What is normal/to be expected? In NYC area if that matters

I currently work at a small PI firm in Atlanta were EVERYTHING is settled presuit. If we’re unable to settle, then it’s referred to another firm for litigation. This whole process seems very atypical to me and the attorneys rarely touch a file until the first liability offer is received. The paralegals handle everything from intake to drafting the demands. The attorney briefly skims (does NOT read) the demand packages and signs. Is this ethical?? Anyone else work at a firm that is run this way??

I am finishing up my second year of practice as a lawyer. I transitioned to plaintiffs pi work from a boutique commercial litigation firm. I like the work and not having to bill. The issue I am having is managing volume. I have about 150 active files some pre-lit and the rest are in litigation. Cases range in value from very small to low six figures. I also take the driver seat for the grunt work on the firms bigger cases which are at or near 7 figure value. I constantly feel (cont.)
