It is an area I never thought of practicing in, especially since my home state has not legalized recreational cannabis. But, my firm is nation wide and I am also licensed, among other places, in CA and CO. I am a litigator and an issue came up for a firm client. Although it involved cannabis, it still was a contract it. In six weeks I picked up four matters for cannabis clients, but also beware.
Although many of the issues are similar, there are a lot of twists, both culturally and technically. Culturally, this industry is the Wild West. Contracts often are drawn by non-lawyers, involving millions of dollars, with clauses that make no sense and are inconsistent. As a small example, one client had two contracts with two related companies, one contract used JAMS and the other AAA.
Second, there are technical issues like regulation and even quality control over the product. For example, we have a dispute about the quality of “sugar” that is not specified in the contract, and major criteria are color and nose, with no objective criteria.
Where do you get experts in an industry where the most qualified people have a long history of illegal production and possible criminal records?
It is interesting and fun, but not always easy.
Through business litigation in general at first. Then I joined a firm that split from a larger cannabis firm. However, the main "rain maker" at my firm is well known in the industry (aka heavy user) and his name gets passed along to others in the industry by pur clients. Soooo...kinda straight word of mouth. It also helps if you are seen around at cannabis events though.
