I live and invest in NY (I too question my sanity on why I still do). I spoke to my lawyer about this issue.
1) it’s more rare than people think. You are more likely to have a tenant refuse to leave than have a random person just break in and claim they live there.
2) that said the best way to protect yourself is to set up a security system. At the very least the security system should call the cops if someone doesn’t insert the code in time. Better if you have cameras around the house to prove that someone broke in.
Does it suck that you have to any extra expense to protect your properties, yes. That said, I found good tenants also prefer the security system as it makes them feel safe. So in the long term it can be a nice differentiator when looking for new tenants.
OP, holdover and nonpaying tenants does not count as squatters. Squatters occupies property without owner’s knowledge or consent.
