I do about a 80/20 split of traditional labor v. Employment lit and I’m beginning to think I should gear towards more employment lit work because labor seems too niche and not sure if it’s a benefit to do mostly labor at this point

Labor work is less commoditized, generally not covered by EPLI insurance and the top practitioners are all about to retire…I would go all in on labor

Where are these in-house opportunities?

I would go all in on labor. It’s so hard to get experience there and people pay more for that knowledge

Labor is a great niche. Unions aren’t going anywhere. Once you build the expertise, and outlast your contemporaries, you’ll get top dollar. Make the time investment.

Additional Posts in Labor & Employment Attorneys

Hello, I’m an associate (almost at the one year mark) at a midsize firm on the EPL team. I did about 2 years of employment law as a clerk during school and know that’s what I want to go into. I’ve asked for more EPL work but keep catching PI cases. I second-chaired an employment trial but don’t see any EPL work for the foreseeable future and wasn’t getting as much EPL exposure as I wanted before the trial. Any advice on a lateral move to a bigger firm with a broader range of EPL work?

Recently received an offer from Ogletree to do only class action work. It'll be a big change for me, I'll be starting as a fourth year. Double my current salary, etc.

What will this be like? It's more of a niche, but lucrative, part of their practice, right? Will I really get good WLB like they claim? I have a nice 40 hour a week job right now, no billables.

I’ve been practicing in traditional labor for about two years now (although about a decade of labor relations experience) but I’m trying to break into employee benefits law. Unfortunately I’m not being given much experience in benefits as I’m pretty typecast as a labor atty. Any advice on how I can go about getting employee benefit experience? My long term goal is to have benefits be my main area of practice.
