Is EPLI work truly unbearable or is it decent in moderation? Is it worth it to apply to a firm that prioritizes EPLI?

Dealing with the insurance company using software and specifically having people on staff to nitpick at your time entries is a pain. Having to remember to get authorization from the insurance company before working on a substantive brief or conducting necessary legal research is a pain as well. Only having one partner, one associate, and one paralegal staffed on most matters is a pain as well, especially on complicated matters or cases with a lot of discovery. You get good volume of work and may have opportunities to "flip" EPLI clients to build your book, but I much prefer to handle cases with clients that are paying the firm directly.

This may sound strange but I enjoy the EPLI cases. They seem to be lower maintenance and usually have quirky and interesting fact patterns. EPLI cases are not bad at all if there’s a mix.

One drawback of EPLI is the lower billing rates. But a lot of high volume clients negotiate deals that are equally terrible for billing rates.

I usually have 3 EPLI cases going on at any given time and I personally really enjoy it.

And I’ll add on P1, it’s in the past typically (fired/resigned employees) so the drama has already occurred versus family law where it’s still contentious and tangled.

It depends on what your alternatives are. I could give you a laundry list of why I don’t like EPLI cases, but I wouldn’t pass over a firm just because they handle a lot of EPLI (ex. EBG). It is ok in moderation. I would steer clear of ID-exclusive firms though if you can since they come with a lot of drawbacks like limited ability to get your own clients.

Why does ID firms limit ability to get your own clients?

I don’t really mind it. As a more junior associate I’ve found partners tend to be more likely to let me run a case independently for EPLI matters.

I don’t mind the EPLI work it’s just the rates that kill your profitability.

For an associate, between 150-350 depending on carrier and policy

Epli work is fine, it's the rates that are awful (and the insurance company cuts and billing restrictions). Epli firms are great for associates as you get early substantive experience and can lateral anywhere if you do a good job.

Case load= malpractice? Small plaintiff’s firm of 25 attorneys. I was a 2 year associate hired and given 50 active files in pre litigation status. 9 mos later a partner quit and I inherited 45 more. I got up to 105 files. Now I hover at 85 active files in varying stages of pre lit. I asked managing partner for help and was told to settle more claims to lessen my load.
