That's awful. But it sounds like you've already done the smart thing by making sure it's all documented. Just make sure you have your own copies of the documentation should you need it. I suppose it's just a matter of time as things play out. So it's stressful, but if you know you're in the right and you've acted in good faith, don't let negative feelings prey upon you.
Why haven't you fired her yet? Three months of coaching and no improvement = termination, in my book.
By the way, "unfair" does not equal "illegal discrimination." Too many employees (and far too many HR "professionals") think it does.
Sorry not sorry but your company is run by spineless cowards. Their performance is lower than everyone else's but they won't term them because they're "of a protected class"?? EVERYONE is of ALL the protected classes, for one thing. "Minority" is not a protected class, RACE is, and we're all of some race.
I'm as left-wing liberal as one can be without being a full-on Socialist (which virtually no liberal is anyway, but we get painted that way by imbeciles), and it really fries me that companies are too chicken s**T to fire poor performers because they're "in a protected class." It demoralizes the good workers, and gives fuel to the racist nonsense that all minority people are successful just because of DEI.
