Tell them you're legally obligated to file with IRS and require W-9. You're in the right, proceed with confidence
Giving you a W-9 is a lot easier than opening a post-judgment enforcement proceeding. I'd keep asking for the W-9.
Yup. What are these people going to do, begin execution proceedings because they don’t want to fill out a W-9? They’re probably resisting because they don’t want to report the income to the IRS.
Explain to your client you lost and send them the check. You shouldn't need a W9 to pay a legal judgment, it's literally a court order. Delay on this and you'll risk them doing something like a debtor's exam that's going to cost much more. Tell your accountant and MBA types to shut up.
One of the tax partners told me the IRC requires us to issue a 1099 to the plaintiff because our client has to report it on its taxes (tax is all above my head)
I would just check the rules. I doubt there are any conditions on paying a judgment, but maybe there are. Probably more of a best practices on your side thing than an actual legal thing
I would also check the local rules for paying. I don’t think you any to chance interest or penalties.
