Yep. Been there and got the tee shirt. They will even bill for the legal fees for the tenant they brought in only to now have to get out! Tenant will pay up, this stops eviction proceedings, property manager will charge you for starting the eviction proceedings. Two months later the tenant will stop paying again. Repeat.
Depends on your contract, some do, sure don't. I've seen where if they vacate early the pavement fee due the next tenant is waived. It's all over the landscape
Rent percentage to management should be based on amounts collected. But look at your management agreement.
Im a RE lawyer who has a RE side business and made sure my PMA was on COLLECTED fees. That said, its reasonable for them to collect the legal fees against you.
What does the PMA say? Whatever it says governs (although if you have enough scale you can negotiate it or threaten to shift your units)
