No they would not be considered an employee. Did whoever you’re talking about not receive a separation agreement? That document should have her end date clearly stated.
Either way there is a separation agreement that states that last day is X. Usually whatever the payout amount is would be how long you can go without collecting unemployment.
I.e. Agreement says your last day was December 31st. But you will get 3 months salary paid out as normal, or take a lump sum. But you cannot collect unemployment until March 31st.
Either way you are unemployed and your resume should reflect that you ended employment on December 31st. Including any background check info
For more context, she is wondering what to put as her employment end date on her resume — and if it would it be okay to put the last severance payment date as the last day of work.
