I have seen plenty of people move from NEP to counsel. But, I do not recall anyone voluntarily lateraling from a NEP position to become an associate.
What’s the purpose of the move?
Couldn’t you try to develop a book of business at your current place of employment? That seems a more realistic path to an equity stake.
Business development success, in part, depends on your practice area and the nature of your current firm. What’s your practice area and what kind of firm (biglaw, midlaw, specialized boutique)?
A recruiter tried to sell me on associate positions at certain firms when I was a brand new NEP. Those firms only had equity partners, so I don't think it's completely unheard of. But I think you should be able to get a counsel role.
Not common. Frankly unheard of as far as going to being an associate. Counsel is more realistic but then you have to consider whether you’d be realistically on a partnership track.
Appellate clerkship would be a big plus. Stepping out for a district court clerkship at this stage would look odd. After an in house gig the question would be whether you can bring in biz from your former employer.
Counsel could be an option. Do you have specific expertise though that could be leveraged? If not, it could be more difficult.
It’s a well-defined sub-speciality of within litigation. Sorry for being vague!
Similar situation for me in NY, I was told by a recruiter that firms do not like hiring people 15+ years out for senior associate positions, it’s breaks up their pay models and they generally feel it creates issues (he didn’t give specifics). The “but you’re getting a far more experienced attorney at a lower slotted salary” apparently is not the sales pitch you would think. 🤷♂️
