The gratuity calculation rule is correct that you checked.
The main factor for payout will be -
Gratuity mentioned as part of fixed ctc vs Gratuity over and above the ctc (i.e purely on company cost)
If its part of fixed ctc then the organisation is liable to pay (unless explicitly specified otherwise in your work contact) else it will be a legal issue. Because they are deducting it from your promised fixed ctc (which is your money anyway).
My responses are completely based on my own experience and not hypothetical. You refer the ffs snippet that I posted above.
