Is it unethical to take a signing bonus if I know I’m leaving in 6 months? A firm is offering me a $30k signing bonus with a 1-year clawback provision. My spouse is likely being relocated to Europe in 6 months, so I’d have to pay it back anyway (or hope they don't notice?). Part of me wants the interest-free loan, but the other part feels like I’m starting the job on a lie.

They would definitely notice. But that is some delightful wishful thinking. But also, what's the alternative? Staying unemployed for the next six months for a job that's not a sure thing? I would personally take the sign on bonus and throw it in a high-yield savings account to collect interest until you inevitably have to pay it back.

Trust me, they will notice. We would bring lawsuits to collect it if it was not repaid. Take the money, keep it in a segregated account and repay it when they ask for it. You never know, your wife’s transfer may be delayed.

I really don't think anyone here understands how taxes work

likefunnyuplifting

Keep in mind that they’ll probably withhold and submit taxes for you based on the bonus and then expect you to pay back the full amount when they claw it back, leaving you to figure out the taxes.

Your reward will be the tax bill you still have to pay

I received a 60 k gross signing bonus in December and had to pay back the after tax amount of 42k in February. What form would i submit to avoid the tax bill?

The tax issue is ridiculous. You got money (taxes were withheld), you paid money back (income is reduced), you file your taxes indicating the above, and it works out.

likefunny

Yeah, but if you’re looking at it as an interest free loan, you have to factor in that you have to wait on the tax return. It’s also something that catches people by surprise.

Take it - and if you’re in California I believe there are new rules in place about clawing back signing bonuses. Maybe your employer won’t abide by those and you’ll be able to
Keep it?

like

Nah, I have seen other people do it. At the end of the day, you have to do what is best for you. Take the money and then act like you had no idea you would be leaving so soon, haha.

Is it possible to work something out with them regarding the relocation? Maybe you can say the relocation came up randomly and youd love to remain part of the team and maybe you can actually move AND keep your job? (If you want that).

Take the money and run.

funny

Yes

like

Take the money but if you leave within the clawback period see if you can just repay the after tax amount.

like

Take the money and the ghost then when they ask for it back.

Do you ghost the summons too?

Key word here is "likely." You don't know for certain. Lots of things can change in a year.

Even if you were certain, you aren't starting on a lie assuming that you are in fact prepared to respect the clawback provision.

Do it and hopefully spouse’s relocation comes on day 366!

Yes

Your spouse is “likely” being relocated in 6 months? If not 100%, anything could happen between now and then. I’d take the job.
