I’ve been putting in some really long hours lately, and when I asked my boss if I would be getting any kind of extra compensation for working so much overtime, he responded with, “overtime really isn’t a thing we do here.” I said "Oh, ok, so I should stop staying so late going forward." He frowned and said that while we don’t have an overtime policy, he expects I’ll be willing to stay late to help out when needed…I’m just a giant sucker, aren’t I?

Paralegals are typically non-exempt employees entitled to overtime pay under the Fair Labor Standards Act (FLSA). They generally do not meet the criteria for the "learned professional" exemption, as an advanced specialized academic degree is not a prerequisite for entry into the field.

As a former paralegal, the same shit happened to me all the time. It’s mind blowing to me how firms know they need support staff to work late (and sometimes be on call) due to the nature of the job, but they don’t want to pay them overtime.

And now as an employment attorney, I am 99% confident you’re non exempt, and therefore any hours above 40 worked each week need to be paid at the OT rate. And depending on your state, you may be entitled to other protections.

Hourly vs. salaried is not the test.

There are only a few limited scenarios that would allow classification as exempt.

And even if(!) met, there needs to be offsets *for someone in that role. Working a 10 hour day should result in you cutting out a few hours early the next few days so that it nets out to 40 hours. You can’t expect someone to work late and also work a minimum of 8 hours.

*if you’re a highly compensated BL attorney this principle wouldn’t apply

This sounds pretty par for the course. This is life in legal.

For lawyers. Not for non-lawyers.
