New to PI at a plaintiffs firm. Any good resources on how to accurately value cases? It seems like so much is just using knowledge from experience.

Please read the book “Running with the Bulls” by Nick Rowley. An excellent book on how to evaluate injury cases.

No way around it. Experience. Ask more experienced lawyers frequently, but always keep in mind that at the end of the day, you know your case best.

Some injuries can be easily predictable and almost formulaic. But my experience has been that formulas are just very generic recommendations and need to always be tuned on a per case basis.

I find other PI lawyers tend to overvalue slightly, whereas defense lawyers tend to undervalue. Pre-litigation lawyers also tend to have less reliable estimates than litigation lawyers

Jury Verdict Research will give you ball parks, but those are incomplete accounts and should be taken with a grain of salt (after all, no lawyers will publicly disclose hidden information pertinent to the case).

One of the most reliable tools I've found is to just poll random people. I ask friends and family what they'd offer and give very neutral factual summaries without giving any clue that could identify my client. After all, a jury pool will be random people.

What's your preference for plaintiff's side? Steady pay at approximately $120k with no bonuses, or a base salary of $70k plus a cut of what you close over a minimum threashold? Midwest-ish market. In both situations, you get a cut of what you bring in.

I currently work at a small PI firm in Atlanta were EVERYTHING is settled presuit. If we’re unable to settle, then it’s referred to another firm for litigation. This whole process seems very atypical to me and the attorneys rarely touch a file until the first liability offer is received. The paralegals handle everything from intake to drafting the demands. The attorney briefly skims (does NOT read) the demand packages and signs. Is this ethical?? Anyone else work at a firm that is run this way??

I’ve done PI work my entire career for over 10 years. I’ve worked in state and federal courts and I’ve traveled around the country doing MDL work and bellwether trials. I’ve had a lot of success making the idiots I’ve worked for wealthy, but I’m still waiting for a moment where I enjoy what I’m doing. I feel stuck working in dysfunctional plaintiff firms/cultures. I hate this profession/career more and more each year. Has anybody been successful breaking off on their own in recent years? Advice?

Hello All,
I am finishing up my second year of practice as a lawyer. I transitioned to plaintiffs pi work from a boutique commercial litigation firm. I like the work and not having to bill. The issue I am having is managing volume. I have about 150 active files some pre-lit and the rest are in litigation. Cases range in value from very small to low six figures. I also take the driver seat for the grunt work on the firms bigger cases which are at or near 7 figure value. I constantly feel (cont.)

I see CJL offers an incentive+ base but I’m curious about that structure.
Any good or bad firm culture to speak of?
Is it impossible to actually earn a respectable incentive bonus?
Am I going to have some partner come cut me out of any cases where I might actually make a solid fee?
