No offer yet, but been told I’m the final candidate and they’d like to move quickly. Ideally I’d want to give my current employer two weeks notice, but I’d only feel comfortable doing so with a signed offer and completed background check. Given the variable time ranges for background checks (I’ve heard anywhere from 1-6 weeks), I’d love to hear how others balanced the timing, especially when new employer wants soonest start date possible. Big law to in-house if helpful

They always want you to start right away. Tell them you'll have to give notice and that you have a trip planned and you'll start after that. Take all the time you need to recharge. You don't want to show up on day one burnt out.

It makes sense that you want to be prepared for a convo if the offer comes. Many background checks can take 2-3 business days. I work in a highly regulated area and a 6 week delay is not likely. If the new employer is slow to get an offer to you, it’s fair to push your start date back a bit to wrap up work and have a short break in between. Congrats on making it to the final round.

Thank you! Appreciate your response.

I had about the same time range proposed to me by my current employer when I was starting, I believe it ended up taking about 5-6 business days for the check to clear (they also needed and requested an additional paystub from me for one of my past employers because they couldn’t find proof of employment via tax search for some reasons).

That said, I was so fed up with the job I was at before that I ended up giving notice before the check cleared against all advice because I knew there wasn’t anything in the slightest they’d find in my background. I also do have prior government experience that raised no queries so felt confident with that choice.

When you receive the offer, ask them what their proposed start date would be (they should still provide this even if all parties know the background check needs to clear) and then make your decision accordingly based on how much time you want. Good luck!

Why are you worrying about any of this pre-offer?

like

Because I have a spouse to think about and the position involves relocation. It’s necessary for us to think several steps ahead.

Is it a small legal department or large? If it’s large, you taking time to move won’t be that big of a deal. If it’s small, fine to give a shorter notice. Ideally you give at least a week notice and then take a week or two off before you start your new job. 1 week notice is totally acceptable.

like

I’d be joining a smaller team within a large legal department. Thanks for the tips!

BGCs don't take too long, but I'd still be hesitant to give notice until you have a definite start date and know the company won't change their plans.

It’s hard to trust the partners/leadership when they want us to return to office as being better when we increase offshoring? Also, the pressure on billable hours when all that really matters is how much our fixed labor costs vs. how much we can bill (which is usually fixed fee or at least a range) and the fixed labor costs of offshoring is significantly cheaper so the hours don’t matter. Am I mistaken by this viewpoint?

Additional Posts in In-House Counsel

Any tips for moving up in a medium/large-sized legal department, aside from switching companies? I work in a collegial environment with plenty of opportunities to create more value, but the management level is fairly crowded and it seems the clearest path to get one of those roles is to be hired into it. What has been your experience? Thanks!
