It’s not that serious. Just go do your clerkship, come back to your firm or any number of other firms that will happily take an IP lit associate with patent agent experience. Boom, done.
I don’t think the clerkship will hurt you, but IMO your CS background and strong academics will be more valuable to you for job placement than the clerkship. If you enjoy clerking, you can try for a Federal Circuit clerkship.
It’s not really about holding spots. The market will dictate whether there is a hiring need. But assuming there is a business need when your clerkship ends (and assuming you left a good impression after your first year), then yes they will likely offer you a return position. It’s easier to recruit and retain people who already have a relationship to the firm, and it’s an easy offer to make if they already know/like you. But like the other commenter said, you have good credentials for IP Lit and shouldn’t worry about this now. Just enjoy your clerkship.
Yeah you’re set - don’t think too much about it. Not many patent litigators have good litigation instincts or are good procedurally in my opinion. The profession values the “science” and think they’re special, but most cases are won/lost at trial based on simple advocacy. Work on those skills in your clerkship.
