When I draft an LOE, I see the retainer fees, attorney fees, and paralegal fees in the terms. Even though I bill clients for my time, I only receive my fixed salary for 20-25 hours a week. I work for a solo attorney and have been his paralegal for nearly a year. When I asked about receiving a percentage, he mentioned that he covers all the overhead costs. So no. Is this a common practice?

Yes, that's pretty common. Even though your time is billable, the firm factors in overhead, benefits (if any), and profit margins. Solo attorneys especially tend to see it as covering their costs rather than splitting the revenue. Frustrating, I know,

It is incredibly common for the rate you are billed at to be 3 to 6 times more than the hourly rate you are paid as a paralegal.

A lot of times your salary will be a percentage of what you are expected to bill, same with the attorney, the rest is used to keep the lights on, order supplies, malpractice insurance, etc. Also keep in mind that while paralegal work is very important you’re not assuming any of the liability that the attorney is, and you are also not expected to bring in any business, or at least you shouldn’t be.

Really trying not to spiral, and my practice group leader has been openly hostile to and dismissive of me lately. Currently a paralegal at a small start up financial services company been there for just a little over a year. I wear “multiple hats” but more recently I’ve done a lot of PM work and some BA work. For those of you who made the switch to in house/corporate law, what was your experience like? Did you have to take a lower position to gain the experience or were you able to argue that your soft skills were transferable to in house?
