Client management isn't even hinted at in law school and is 90% of what I do as a PI atty.
100 bucks they’re gonna try to dispute your fees too; some clients suck
#1 rule: never trust your clients.
Never!!
I put every little word in writing and we both sign with two witnesses.
Do all of the above! Hate that for you. Client management can be so difficult.
We use text messaging software to get authority. It's quicker and provides something to throw back in their face. We talk by phone, get permission, then tell em to reply to a text they are about to get to confirm their position.
This ^^
I have Ringcentral for my firm and I can text from my work number. I always get confirmation via text.
100% I want it in writing
I just - like 10 mins ago - sent a revised special damages list for client to sign, which had updated medical bills - all of which the client provided to us - so I can have it in hand before supplementing to the adjuster in a prelit case for a revised offer. I’ll probably have to put it in suit regardless. But all because I simply do not trust clients.
Not to make excuses but my office phone (which records) was down so I had to call on my cell. Was contacted by the adjuster at 4:59pm on Friday. Immediately called client and got authority. Documented call in file. Left office. Subsequent emails with adjuster to negotiate significant premium of payment on their part. My remote access to my computer was also down over the weekend so first thing Monday morning confirmed with client in writing and I receive a call saying he never gave authority. It’s a total cluster.
Ouch. Written confirmation always

Isn't final confirmation them signing the release? If you verbally agreed to amount with adjuster without a signed release, is the adjuster trying to say it is binding? I often ask them to send me a release of they tell me that is their top offer, and I tell them I will get it signed if my client agrees to it.
There was agreement via email. If they really wanted to, they could file a motion to enforce the settlement.
