pros: have found it makes clients feel the prenup is more fair. shows trust and long-term commitment. agreement can be revisited after the 5 yrs and it is likely finances and other circumstances have changed that the couple may now want to incorporate. conflict reduction esp if the marriage lasts much longer than the 5 yrs; prevents outdated terms drafted during very different times from applying.
cons: obviously lack of protection after 5 years which is an issue esp for high asset individuals. it has been argued 5 years is too short (a lot of life / marital changes happen after the 5 yr mark). can create uncertainty.
