Looks like yes for non-economic damages but if you file after Jan 1 the cap is going up to $500k. And looks like you can hit them twice (per defendant) if you have loss of consortium. Not sure if the estate has its own claim in CA tho that could recover pre death pain and suffering…Death
case generally is going to have more economic damages so get a good Econ.
And (again not sure about CA) but generally best to locate all heirs and have them work it out and agree re estate and claim prior to suit
