For the lawyers who have done PI work for a long time on the plaintiffs side (15 years+), at what point or what signs were there that made you realize you really are capable and cut out to do this kind of work? When did that feeling of being completely in over your head go away?

When I realized that a large number of PI lawyers were only marginally decent and were making a living. I figured if they could do it, I'd be totally fine.

I was thrown into the deep end first-chairing complex medical malpractice cases. By year 4, I had a good understanding of working up and trying cases. But even after that, I still experienced mistakes and skill development. It’s called the practice of law for a reason. One should always be learning and errors are often the best teachers.

I jumped ship six years into practicing PI for a firm that was sinking fast due to the owner’s gambling addiction. I went on my own and never looked back. That was 14 years ago.

Tomorrow, I know I will be asked to continue pushing forward with pre planned campaigns that upsell products and services that to groups already in dire straits. I’ve done PI work my entire career for over 10 years. I’ve worked in state and federal courts and I’ve traveled around the country doing MDL work and bellwether trials. I’ve had a lot of success making the idiots I’ve worked for wealthy, but I’m still waiting for a moment where I enjoy what I’m doing. I feel stuck working in dysfunctional plaintiff firms/cultures. 4th year at a mid size PI firm. Got pulled from litigating MVAs to help this solo we hired start a med Mal/nursing home practice. 1 year in and it looks like I’m two steps backwards in terms of getting paid because we’re a year or more out from a lot of the fees hitting. I received a job offer from a PI firm (MVA and tractor trailer cases) in Houston, Texas; the bonus proposed was 2.5% of attorney’s fees for any cases settled each quarter. We are assigned 50 cases a quarter and the top attorney clears $25K each quarter. This is my first time working at a PI firm. Can anyone share any guidance? Is 2.5% industry standard? I'm a 6th year attorney in NYC. Strictly defense work; started out with the City Law Dept, did a year and a half of med mal/construction, and for past year and a half have been at a well known defense firm working on high exposure construction accident cases. A defendant generally is liable for all harmful results that are the normal incidents of and within the increased risk caused by their negligent acts. If a defendant's negligence was a substantial factor in producing the plaintiff's injuries, the element of proximate cause has been satisfied and the defendant would not be relieved from liability for those injuries even though another force concurred..
