Surely they want to server full NP and if choose to abscond might have to face legal action not sure...!. Any of u guys was in this situation before ? any suggestion u have.
hey, check with your potential employer if they can buy your notice period? Also I don't feel it is legally binding on each party (you and your employer) to honor the employment especially during probation. I would recommend you read more about it

You will only required to basic salary per day.
Read your offer letter carefully and read exit policy of company as well.
If they have created your PF account then I'll suggest to get clean exit, saala baad me pata nai kya beach me aa jaaye.
If you are on Probation there is no 90 Days NP concept, Just send the email with your offer to HR . I think 1 month is the NP so tell that to the New Org and ask for time to join.

What other options I had..
My new employer wanted me to join in 55-60days, I told them that I'll convince PwC to release me early , when around 45days were left. i've informed new employer that won't be able to join in 60days. Please change my joining date post 90days and luckily, they were okay with that.
I was ready to pay shortfall of notice period, use of unutilized leaves but they didn't budge.
