I am in the process of talking to an attorney but wanted to check if anyone here dealt with this scenario or have suggestions: closed on house mid Nov. inspection identified hvac issue that needed fixing. Seller got it “fixed”. Now it’s January and HVAC isn’t heating well, cost estimates around 5k. Do I have any recourse to have seller pay for repairs or am I out of luck? lol l

Get a second opinion. In the morning/daytime, get a spray bottle fill it with water and dawn soap. Spray the lines and see if any bubbles appear. If they do, that means there’s a leak in the line. Also maybe try asking AI some questions, like I have a model x this has been done to it etc. I watch YouTube and ask AI even if I call someone out so when they get there I have a better understanding of what’s going on and expect etc.

What do you define as fixed? What did the seller define as fixed? What was in the contract? What was the original problem?

The contractor who fixed it should offer some sort of warranty that could be your first place to start.

I don’t think you have much recourse here because they fixed the issue. When the issue was fixed, you should’ve asked what sort of warranty. The contractor is giving and if it wasn’t up to your standards, then you should’ve asked for more money.

Not saying 5000 isn’t a lot of money, i’m not sure it’s worth the money of paying an attorney. Talk to one and see what they say.

No. The seller is not liable for this. There is usually an AS-is clause in the agreement. You have to fix it yourself. Welcome to homeownership!

You’re out of luck, unless you purchased a warranty. Homes are sold as is. He can sell it broken. But your best recourse would be any warranty on the work that was already done. I didn’t bother with mine. I ripped out a mini split heat/ac that was leaking freon and replaced it over the summer. Moderate difficulty if you get the pre-charged lines you don’t really need an HVAC tech. It was $2500 DIY, took most of a day. My bill went down with a better seer rating.

Something similar happened to me but my roof was the culprit. If you go back to your agreement, and the seller had agreed to fix, then you’ll have to prove it wasn’t fixed & they will be liable for fixing.

This is pretty standard we just moved and are finding a lot of this with our house. We inspected and reinspected after repairs were done. Still lots of temp repairs are popping up.

I always ask for this. It doesn’t cost the seller much so they never argue with it but it can protect you from those early surprises

Your best bet is going back to the company that did the repairs. Did they send you an invoice? Was that company licensed and bonded? Or did they just give you their word that it was fixed?

What exactly was wrong with the HVAC in the first place?

Most likely there's a hole in the evap coil. Probably best to replace, but if you don't have the money toping it off could buy you some time.
Also look at the price to replace the whole system, and call multiple companies... I manage rentals - replacement costs here vary from 5-6k to 12-13k based on the company quoting

I'm under contract for a new build in progress that won't be done until much later this year. I fully expect interest rates will be higher than what I originally estimated. I may or may not try to lock in a good rate early, but I'm planning on renting it out and this throws a bit if a wrench in my margins.
