I used to thrive on the energy of litigation. But lately, just seeing “Discovery deadline” pop up on my calendar makes my stomach drop. I’m tired of the games, the obstruction, the motion practice that goes nowhere for months. I find myself craving resolution, even if it means compromise. Has anyone else hit that wall where you start thinking… maybe mediation isn’t so bad after all?

It’s normal to evolve in how you approach conflict and resolution. Mediation isn’t the enemy—it’s just a different tool, and sometimes it fits better than a fight. You’re not soft for wanting peace over prolonged battle.

This is a good point too. I spend a lot of time bringing my clients to reality too. If you don’t, you’re contributing to the problem too

I think truly evolved counsels lay out the tools they can play and pull but know what is useless exercise and reach a compromise sooner. It’s always the silly ones who want to duke everything out even when we’re experienced enough to know how things play out

What is considered a “large” caseload in employment litigation? I work at a large L&E boutique law firm and handling about 14-15 active litigation cases in state/federal court or arbitration. Some of these matters are multi-plaintiff and multi-defendant cases, but none are class actions. This does not include any matters I am handling in the charge stage or in pre-litigation. Not sure if that’s a typical caseload or not?

Case load= malpractice? Small plaintiff’s firm of 25 attorneys. I was a 2 year associate hired and given 50 active files in pre litigation status. 9 mos later a partner quit and I inherited 45 more. I got up to 105 files. Now I hover at 85 active files in varying stages of pre lit. I asked managing partner for help and was told to settle more claims to lessen my load.
