Sure. The best plaintiffs med mal younger attorney I know comes from comp. She spent her first few years deposing doctors for comp. She knew the medicine, knew how doctors worked. She's great
Yes. They are similar in tactics but the laws and claims systems are very different. PI is not as heavy on forms and paralegal work. It will take time to master the nuances.
Yes
I guess what I mean is, let’s say a job posting says “must have 3 years personal injury experience” as they all seem to. Would 3 years of workers comp count for anything? Like I’m sure not enough for a lateral in the high part of the salary range, but at least maybe a likelihood of being considered?
Yeah probably enough to be considered
Yes! But study up before you interview. Read an auto litigation book and know the basic insurance laws that apply. Having someone with WC knowledge in general or auto PI is really helpful because the two areas overlap a lot but most PI lawyers know nothing about WC.
I literally did this. It’s definitely possible
How long were you in Workers Comp before transitioning into PI?
I worked 2 years WC before joining PI. Best decision I ever made.
Honestly a big reason was because my former boss wouldn't give me a much needed pay raise. So I doubled my salary moving jobs and I like the field much better. Less clients, less fighting with multiple parties (employer and dept) and less starting at a disadvantage (IMEs). In PI, you convince a judge, not a stupid dept that always believes IMEs. Oh and pain and suffering damages... Lots to like.
