If you were hired specifically as a remote worker you've got every reason to push back on that. It's possible the policy wouldn't apply to you. It may come down to whatever exists in writing. If you were told you'd always be remote, but that wasn't established in writing, you may be out of luck. You should still object to it and make your case.
You should be able to at least try without losing your job. Whether or not management will go for it is another story. But you've got very valid justification for making the ask in my opinion. You're right on the cutoff area AND you were hired to be remote. If they're at all reasonable, they're not going to fire you for simply asking the question.

Is that 38 miles as the crow flies, or 38 road miles? I'm phobic about highway driving, maybe you are too. Which would surely make your drive distance a couple of miles longer if you had to take side roads, wouldn't it? Because of your medical condition?
