I would say “sorry for your loss, let me know when you are up and running again and I’ll see if I’m available to come back” and start looking for a job ASAP. Nothing good will happen there. Sorry

Different opinion. If you can afford to stay on and get them through this there could be a good reward on the other side. I would tell the lawyer you want an employment contract to stay on. You protect yourself and maybe get a good benefit while helping someone out
I too agree with this. The attorney may have access to funds that are not tied up and could be used to pay business expenses during the probate process. Probate courts are aware of business situations and would have something to put into place to support a business so it doesn't diminish or shut down while it is in good standing and operational. I would request time with the attorney to see where the company stands as far as provisions for the business to keep running. Then go from there.
Wow, what an unusual and sad situation!! From what I know, probate can take weeks or even months, depending on the state and complexity. If they can’t pay employees, I’d be cautious about working without a clear agreement. I would honestly consult a labor attorney to understand your rights. Hope things get sorted soon.
