Hi
my cousin is working as a design engineer(related to mechanical engineering). He is havjng 4+ YOE for the same role. He has done diploma in data science from IIIT-Banglore in UPGRAD. Now he wants to look for an oppurtunity in IT field. Can someone let us know the process if u r aware of so that it would be helpful for him. he has done few live projects in UPGRAD in order to get his certification. Upgrad is 1 year course Cognizant Tata Consultancy Accenture Infosys Deloitte EY PwC KPMG

Yes FMLA will not protect you if you abandon your job. Job abandonment means you don't return for at least 30 days. The consequences of job abandonment are that your firm can make you repay all benefits from your leave, even their share of your health insurance. They may chose not to, but I went back for 30 days so I didn't have to risk it. I was able to get a new job and gave notice right after the 30 days.
What is the common law doctrine that permits a firm to clawback benefits/pay provided under a parental leave policy that says nothing about clawback if don’t stay with the firm X days after leave ends?
I gave my two weeks notice the day I came back from maternity leave without any issue. I also know several who gave notice while on maternity leave and there was no issue. The only thing you will want to check is whether the firm has a clawback provision on maternity leave and your bonus. Mine had neither.

Prob would burn at least some bridges if you don’t offer 2 weeks of non-leave transitioning time, even if they ultimately decline it since you presumably transitioned matters before going on leave.
Do firms really let you quit after taking parental leave without ever coming back to work? I would be worried they’d try to claw back the pay during leave if it was a long period of time.
I would presume that policy would be written somewhere in the parental leave policy or else it’s not an option? I’ve reviewed my firm’s policy and it’s silent as to clawback.
You should read the fine print of your firm’s parental leave policy. Many require you to pay back what you were paid while out on parental leave unless you’ve returned for a certain amount of time (30 days, the same amount of time you were out on leave… it varies by policy).
Just do it before you get back, they will be annoyed they have to redistribute your work and set everything up with HR. Cleaner to give notice before you return.
I gave notice two days after I came back from parental leave and had no problems. As others have said though, I suspect you’d run into issues if you just didn’t return from leave.
FWIW it was twelve weeks of leave. So, not an enormous amount of time but not just a couple weeks either.
