C&F question: any attorneys here with a DUI conviction on your record? If so, did you have any issues clearing Character & Fitness in a new jurisdiction?

DUI occurred nearly two years ago as a senior associate in state X with no corresponding discipline in state X; however, now trying to get admitted into state Y...

Obviously, this is an extremely regrettable event, and will make that clear to C&F, along with post-DUI progress.

Curious if anyone else here went through something similar.

Had to jump through an extra hoop waiving into state Y for me. Initial rejection and had to do an appeal hearing with a bar council member who was just doing due diligence to I assume make sure I’m not a total loser. Immediately admitted after the hearing. Don’t get me wrong, I was stressed at the time. But the hearing official couldn’t have been nicer.

Dang, you were initially rejected? For just one DUI? Was it an aggravated DUI or pattern?

I've heard that most C&F committees will make a practicing attorney with a recent a DUI attend a hearing but that most pass if the bar senses remorse and rehabilitation. Any clue why you didn't pass initially?

Friend got a DUI in the law school parking lot. He's barred. You will be too. Don't worry.

I had a DUI in college (~6 years prior to applying) and C&F just required an extra hearing before the Board of Law Examiners to ask some questions (seemed like they just wanted to make sure I’m not some scumbag). Was green-lighted within an hour of the hearing. I did include a personal statement with my application explaining the circumstances, what I learned from it, and highlighting growth/steps taken since. Not sure if it made any difference but it likely can’t hurt if written properly.

For clarity this was an application to take the bar, not waiving into another state, so I was not licensed anywhere at the time.

OP: get it expunged! That way you look better for divulging it to a non government agency. Whether you have to grovel is state dependent.

Depends on the state, but mine requires disclosure of any expunged records as well. Seems to defeat the purpose of expungement but whatever

Asking for wife who's also in banking. If she got ~$100k in signing bonus in 2019 for 1 year commitment in CA and started FT in July 2020, assuming she leaves before July 2021, can her employer claw back full amount in California? Some say it's much tougher to do so under CA law but wonder if anyone has any insights. Banks won't likely care about analyst signing bonuses, but associate bonus at EB with diversity bonus can be significant. If she quits before, she won't be going to another bank.

I’m not naive or fresh out of law school, but I’m at a point where I’m saying to myself “Why can’t I have it all?” I’ve been offered a job for more pay and less hours and I keep thinking to myself, what’s the catch? I know people will say no promotion potential or that’s not how it works…but what if it could? What if you make yourself valuable by still setting your boundaries? Why would we resent someone who has that opportunity?

I'm two years into this job where I lateraled, and I need at least one partner to "sponsor" me to have a future with the firm. I've been a government attorney for nearly three years now and have worked in the same office/division since I passed the bar. I've yet to receive a promotion other than two cost of living increases (in sum, a pay increase of 6k over 3 years). I know this is meager, but I'm mostly ok with it, I just want to see some recognition.
