Were you physically at the facility wearing PPE etc.. then I would say you were in direct contact with this air borne disease and placed at risk... and might present your case that way. If you were sitting behind a computer at home and not with other colleagues in a CRAMPED office like I was - and away from the front lines then I would not feel right protesting your disqualification for Hazard pay. I worked for a 'healthcare"\billing org during this time and everyone could have telecommuted - but the owner of the "healthcare<ha-ha" company made everyone come into the office and thought it was a hoax and was an anti-vaxxer who did not even know what mRNA is . I was the only one who did not get Covid for the 2 + MISSERABLE years there....
You don't need to work directly...so far you worked in a vulnerable environment, you should be entitled.
Similar situation. We were not frontline workers during the pandemic (Healthcare I.T. - NYC), yet we were supporting their efforts. I felt all those frontline workers did an amazing job under often horrific (and life threatening) experiences, quite a few were completely burnt out after a few yrs.
IMHO, they deserved "combat" pay, extra time off, something to acknowledge all they did to care for their patients, protect the public from even more suffering, I'm unsure, but I believe my org did try to address their needs.
BTW - same feelings about all the underpaid souls who kept grocery stores (bodegas) open, running, so the rest us could survive. I don't think most of those folks ever received anything for their heroic efforts and that's tragic.
OMG I would be freaking furious. That is ridiculous and it really is their problem. They should have made sure you qualified before putting it into your account. I am so sorry that happened OP. I definitely think they should let you keep it because they already gave it to you
