That is tough. I know you want the work and money, but at this point it sounds like they are basically stealing from you. Is that somewhere you want to make full time/long term? Would they suddenly start respecting your boundaries as a FTE, if they ever offered that to you?
It may be time to have a sit down and outline your boundaries, since they seem unwilling to commit to permanent. For me it would be: moving forward I need to bill all my hours. If it is only 40, then that is all I can work for that week. And I’d be prepared to end that relationship. But, it’s an individual assessment, and I don’t know all your circumstances.
What I do know is you deserve better.
If you can’t set boundaries now, you can’t set boundaries as FTE. This is the “grooming” period.
If they're implying you shouldn't bill what you work, and won't accept 40 actual hours of work (ie: 30+ hours of overflow going unaddressed) then you need to run for the hills. This is not a hard one, unless the alternative means not being able to provide for your basic needs (in which case it means delay, but leave anyway).
Any place that tells you to keep working but stop billing is unethical, besides illegal, and there is no FTE role at the end of this road.
For real, it's a tough situation. I would start to brush up on my CV and see if other places are hiring while you are on this one. If you find something, it could be a good bargaining chip for full-time or a better fit that will respect your hours. Look out for yourself.

This is at least borderline, if not legitimately illegal. Period.
Either they pay you hourly + 1.5 the rate for anything over 40 hrs, immediately hire you full time, or GTFO of there.
They’re clearly waiting to see what the EOY financials look like and will be dangling that carrot through December with no promise of fulltime.
You’re being completely taken advantage of.
So start a 401k tuition that should work
Bill your time or stop working overtime. It’s wage theft and if you have it in writing that they’re saying you can’t bill over but are making you work for free then you should find a lawyer.
