You won’t have any penalty. Rolling over 401k (traditional) to IRA (traditional) is non taxable and not penalized. Traditional to Roth conversion is taxable (as ordinary income) but will not be penalized. So do the pre tax (traditional) rollover when ever you want. And then do the Roth when ETR is lower.
