It’s not illegal to fire someone who is pregnant. It’s only illegal to fire someone BECAUSE they’re pregnant. Your wife has already handed her employer a gold plated reason to fire her, that they can use at any time.
If I were you guys I’d do it early with the expectation that she will have to find another job in the early days of her pregnancy. Leave it late and you risk her getting fired and needing to find another job while she’s very pregnant.
Of course the other option is that she start going to work in the office like her employer ordered her to; that’d probably protect her job until she got to the other side of her parental leave.
This is true. You can still be fired if you're pregnant just not because you're pregnant.
In my previous company, a pregnant lady was fired for poor performance. The discussions were going on for 5-6 months and by the time they built a solid case, she notified HR that she was pregnant. They had to do more legal reviews to make sure they had a strong case and she was fired eventually.
Your best bet is for your wife to go back to work physically until such a time that her doctor advises her not to and provides a note, or until her maternity leave starts. If working from office is a stated job requirement, she can be fired for not doing so. Best to consult a lawyer if you're worried.
I don’t work in employment law but pretty sure it’s discrimination/illegal to fire someone for being pregnant however if they have been documented the come back situation and your wife hasn’t - I don’t see why they couldn’t let her go at any point. For many companies 100% wfh was a temporary situation and if it isn’t stated in her contract and they asked her to rerun back- then they already have the upper hand.
Your going to have to tell them she’s pregnant at some point, and the end result is going to be the same so idk what the goal is here. If they are going to use this as a cover to let her go it won’t matter if it is now or in 2 months lol. It sounds to me like your wife should prob just find a new job that’s actually 100% remote if that’s what she wants
