Can you get fired while you are pregnant in NJ? My work has been slightly affected due to what I am going through but my manager sent me a long email today pointing the things that had to be fixed. We have weekly one on one calls to discuss work. Maybe they are collecting evidence before firing me.

If I were you I would ask my doctor for light hours/duties sick note to substantiate strict 40 and blame anything on too much work. And then work strict 40. Its not possible to perform 150% while pregnant for everyone and some managers are just assholes. Not saying that's whats happening but just in case

I was pregnant with twins and my doctor wouldn’t do this. I said I thought the stress of working 65hrs a week was negatively impacting the babies and the doctor said all of my (and the babies’) vitals were great and no need to worry. It sucked

Obviously more facts would be needed. But unless you majorly messed something up or are really unproductive and it all stated before the pregnancy and their documentation is perfect, etc., they are taking a huge risk firing a pregnant woman. A good plaintiffs lawyer can typically beat money out of the company in his/her sleep if the company is ballsy or stupid enough to fire a pregnant woman.

Document back exactly what you are doing to address all his points and cite your conversation (as discussed, I am doing abc to address xyz…) and In the meantime find another assignment if you feel like they are hassling you - it’s not worth the stress when you are preggo

K1 - It's insane to hear this. I grew up in a fairly fundamental Christian environment (no longer practicing), and the things you experienced were still common within that community through the 2010s. I rather doubt things have changed much since. No wonder this country can't even pass a simple parental leave law.

More details would be needed to give a better answer. Overall, no, you can not be fired because you’re pregnant, and if there are performance issues that the manager is citing that are directly related to your pregnancy then I would say the manager does indeed have to tread lightly, especially if you have or plan on asking for accommodations to counter the perceived decline in performance.

NJ is an at will state. They cannot fire you for being pregnant. It’s against the law. They can fire you for work performance which is more than likely the route they may go if they are taking note.

Check and see what your company’s policy is on disciplinary action. Do they provide formal verbal and written warnings that involve HR?

If they are trying to fire you, depending on how far in your pregnancy you are, can you take maturity leave and then FMLA? This will give you some time to spend with you child and potentially help you with timing to find a new job if you are looking to go that route.

There’s no reason you have to put up with a job you hate. I spent many years working in a toxic environment with a boss who gossiped and lead through fear. He wasn’t really much of a leader but basically a foreman. And he could make my existence miserable. I admit that it wasn’t easy to find another job but the bottom line is: trust your guts. If you feel something is wrong it’s because it probably is. Don’t second guess yourself. Look for options and and fight for your mental health.
