I recently got a night shift project (2 days ago) that requires me to work from 10:30pm till 7:30am
I'm not comfortable with these timings and I'm thinking to ask my manager to put me on Bench (Due to medical reasons that involve mental health)
Is it a nice idea to say a firm No to a new project I'm hardlocked into, due to night shifts?
Can you incorporate SCCs by reference in a DPA?

AD 1- even after the lottery, which you're right is once a year, everytime you transfer to a new company, it's a new case where you may be cap exempt but still need to be 'approved'. My transfer took 3 months!!
I moved from Canada to USA on an L1A. A transfer within a company. Pretty easy and fast to get, if you're senior enough. But that was pre-trump.

Just went through this process and honestly? It’s gonna be tough. Agencies are still sponsoring visas but it also depends on which citizenship you hold OP. It’s easier for Aussie’s, Canadians and Brits. I’d recommend what @Zenith1 said otherwise.

Yes! It takes forever :( There are delays and other roadblocks like mountains of paperwork and lots of back and forth with lawyers. My visa took over 3 months this year in premium processing. Most companies aren't willing to wait that long in cities where there is no dearth of talent.

OP - where are you? Do you mean you want to move to NYC and you’re currently somewhere else? If you work for a network, highly recommend looking into L1 visa - if you have an NYC office, it’s the easiest way to move as it’s a company transfer. Eligibility: you must have worked for the company for 12 months, within 3 years. I got mine with a previous employer so not even through current company! I’ve recently had my L1 approved. It took a couple of months to sort and included a lot of forms to fill out, immigration lawyers (which the company organised) and a day trip to US embassy!
Zenith 1 - right now I'm finishing an internship in an agency in nyc but I'm I'd like to find a job here. Thata why I was wondering which agencies are more likely to hire international people
@acd1 is it tough if you want to switch companies but stay in the US? you have to switch visas right? unless you really love your agency/US
OP are you British? If you’re under 30, another option is a working holiday visa - you couldn’t do US but as someone who did this in my mid-20s in Australia, it was an awesome experience. Find a job at a network, do it for a year and ask to transfer to the US! Agree with Marketing Manager 1 - most agencies will certainly sponsor in the US but having connections helps. (I got mine because the agency knows i’m a safe bet as they’ve seen proof in the work and i’ve built relationships with people in the network). There has to be an element of “security” on both sides as companies pay for visa and you’d likely be tied in for a couple of years. Also networks will have approval processes via parent companies so having senior advocates will help! Good luck!
