Consult with a plaintiffs’ side employment lawyer in your state.
If OP hasn’t specifically asked for accommodations relevant to a documented disability, they have no case. Being asshats regarding covid or reviews or raised isn’t actionable.
Can you get a doctor's note? Don't they have to provide accomodations (as in you WFH)? Also put everything in writing, your requests, conversations and an email follow up each time.
ok good! keep everything documented with dates and times and get your doctor on board. I also hope they get some type of violation for the lack
of accomodations in the office. In this case, it's actually helpful for your case but its still rotten in for any visitors to the office that may need it to be complaint. Especially for emergencies- thats just not cool! I hope you come out on top and get all that you need and want!
Seems like you should focus on the real issue-
if your office space is not up to code for your documented disability (and they are a company that is large enough to have to make those changes). The rest (2 roles, covid, etc. ) is not relevant.
If you want to remain employed you would be wise to have that documented and ask for the required accommodations before you return. But you can’t force them to let you work from home. It may just not be the right fit for you.
Also: the performance review and raise thing could be seen as retaliation if, and only if, you were singled out and it started after you asked for accommodations.
My entire team has not had reviews or anything whilst other departments have had them as well as raises. So I don't think they are singling me out necessarily.
I've even been denied performance reviews since beginning of pandemic. I have gotten no bonuses, raises or promotions (yes, I did ask a lot) for handling the work load of 2 separate roles for 2 years. Idk what else to do.
