The biggest thing I keep running and running around my head- after 8 months, why did he drop me? When he texted ending it l….it wasn’t me, like we weren’t us, his words were from someone else, like I didn’t matter. It doesn’t matter how much it wasn’t about me, how he chose to end it, and that’s what crushed me. Who I thought I knew was wrong. I want to know how close he was to loving me.

Comforting others:
When someone tells me bad news regarding their health, I say everything I am supposed to say (I’m sorry to hear that, I’m here for you, etc) EXCEPT “everything is going to be ok”. Because I can’t guarantee that and I really don’t know if everything is going to be ok. I was taken aback recently when a friend told me I am calloused and cold-hearted for not being able to say those words. Is she right? Should I start saying this for the purposes of providing comfort only??

My sister might divorce with her husband, they have a baby of 1.5 year. We came from a divorce family and honestly never thought it would happen again - I feel powerless and I don’t know what to do. I feel bad for my sister but I am also mad at her (the fault is always in the middle) because they are not trying to fix it. I am also scared for the baby, I perfectly know what it means to grow up in a divorce family and as much as parents are present is not the same.

I broke up with my EX mainly because the relationship with my child and her was not the best, it sucks but I have to look out for my child, So far I am able to do the things I can do now. It is not the I am not Hoeing around but the simply fact that I can hang out with friends and go watch my son play baseball is a great feeling now. I feel at peace now, in somewhat of pain because of the breakup but I am at peace now.

Am I particularly uptight, or is writing meant to be done alone, without a partner talking to you? With past partners, we chat through script notes and then I go off to execute. Current partner likes to sit and chat as I write. To me, writing is crafting a conversation. So I can’t talk to you and simultaneously talk to this audience. Of course I can just say “I’m gonna go write.” But since we’re both CD level, I’m like…is this his first rodeo? Maybe other writers are different though.

Been for a company for over 2years. The executive team is very much a boy's club. There are a few women in management roles but zero ethnicity diversity there. I raised my concern to HR in feb. What do you think is a reasonable total fee for a prenuptial agreement where both parties have significant assets and there is some negotiation? What about for a dissolution with a complex asset situation and children? I had a prenup a few weeks ago that came out to $7,000 and another about $5500, and I didn’t overbill, but I am willing to write some off if that seems excessive or I am just slow. My client wants both parties to list assets & liabilities as an exhibit to their prenup without values, but waive the right to know the actual valuation of those in the prenup itself. My initial thought is this is a terrible idea & would probably make the prenup easily voidable since a main requirement for a prenup is for both to understand the nature and value of the other’s assets. I will research in my jurisdiction to confirm, but has anyone ever heard of/done this? Thoughts?

In OAH the NCP has submitted no actual earnings only hand written sched c (Uber). NCP lied under oath about how pmt for the car was made. Said a friend paid for it and he is paying a friend back. I have bank evidence that shows every car pmt came from NCP Bank and only deposits were from Uber. Problem is the car was paid off in 2018 and the CSO was from 2018. CP asked 4 mod and it was brought up to ? his credibility. How do I get it in since its not about $ now? Judge granted 1wk 4 adtl exhibits

Does your firm regularly adjust rates? I read an article suggesting it should happen annually. Curious how regularly firms adjust attorney rates.

Have any of you taken "low bono" clients while working at a firm? I want to take on a low bono client or two but not sure who would get the money. This is a contract opportunity through a non profit so I'm assuming a 1099 will be issued. The per hour rate is significantly less than my billable rate. I would (obviously) like the money but my real objective is just getting experience/networking since I recently moved to a new state and don't have clients of my own.

What are your client follow-up/communication policies or practices? I’m hearing more and more that clients don’t like the long periods of time with little to no contact. From my perspective, since I bill for my time, unless I have an update or need something, I don’t initiate a call. Also, clients hold on to important info and don’t initiate a call cause they’re waiting for me to communicate with them.

I’m a second year associate at a small, but reputable firm. My caseload is almost entirely made up of clients who were referred to one of the partners but the partners are too busy so I end up taking the case. The clients are told up front that an associate, rather than a partner will be taking his/her case. Is attaching communications between opposing counsel and the filing attorney when filing a response to a motion poor form?

Working on a divorce where the father is claiming that he is unemployed because of the previous administration’s actions with DACA (he was brought to the States as a child). I know that the memo rescinding DACA was ultimately vacated—but OC is unsure whether this would count as voluntary unemployment for child support purposes. I believe it does as the application period to renew DACA benefits was reopened in 2020. Thoughts?

What days does your firm close for the holidays? Are you all working on January 2nd?

(I don't want to be a task master, but as an associate, I was expected to work a half day on the 24th, and a half day on the 31st. I'm closing the office 23rd and 26th this year, but currently listed as open on Jan. 2nd).

How does everyone bill for family law matters? Do you always bill hourly or is there some flat fee, monthly or quarterly fee structure that could work, even in contested matters? I have cases that the clients end up spending $20-$40,000 on a contested divorce and this is really out of their budget. I feel that if my firm could charge a flat fee of $10-$15,000, it would still be beneficial from a client predictability and volume standpoint and would generate more referrals.

If my clients are the firm’s clients, it’s up to the firm to let them know I am leaving right? I’m leaving for a government position so I can’t take them with me anyway.

Family law associates - how long have you been practicing and what is your comp structure?

How do you as the attorney balance your advice with your client’s wishes? Meaning when what the client wants is not, in your opinion, in their best interest, when they want to settle for less “to be done,” or pay more “to get him out of the house,” when do you stop pushing back and give in? I’ve lost at least one client before for pushing too hard to get what they were entitled to when they wanted to give in and I’m fear I’m facing something similar now.
