Every time I see people level class based criticism on the practice of law, I can’t help but think: you’re not actually critiquing lawyers—you’re critiquing capitalism. Lawyers don’t set up a world where justice is sold by the hour, where your freedom depends on the size of your wallet, or where access to rights is rationed by income. That’s capitalism. We’re just one of the clearest mirrors of it: professionals who embody the same structural inequities baked into every other industry.

A few months ago, there were articles about how Juniper Park/TBWA’s hand sign saved the life of a kidnapped girl in a car. But the next day, reporters asked the guy who called the cops about it and he said he had no idea what the hand sign meant, he actually called the cops because the kidnapped girl kept mouthing “Help me.” I’ve heard of agencies exaggerating sales results or click through rates in case studies, I really hope JP/TBWA isn’t exaggerating about, literally, saving someone’s life.

I was hired by client to draft a form MSA and SOW (the client is a freelance HR coach). She showed her form to another freelance HR coach and now they want to use the form I made for my client and my clients asking if that’s ok? Any advice?

Negotiating a settlement. I’m at $10k, opposing counsel is at $20k. My client won’t go higher than $15k. OC has come down to 17.5k and says his client won’t budge from that. Do I offer 12.5k so we can hopefully meet in the middle at 15k? Is that how the settlement game is played? Seems dumb we can’t just say let’s meet in the middle now and be done with this. (I’m a first year, first time negotiating a settlement on my own and I don’t want to screw this up!)

I know some of my colleagues are recording their standard fees as time so that it counts towards their billable hours. It infuriates me but am I just being naive by not doing the same?

I’ve felt seriously burned out at my firm for a long time, and now during this point in the year I’ve reached a new level of struggle in terms of trying to be productive. Second year associate here. How should I deal with the one partner in my practice group who seems to exclusively give me lousy assignments that we’ll never get paid for? I get great work from everyone else.

Transactional associate. Lateraled 6 months ago and one of the biggest pain points has been my new firm’s inclination to “hop on a call”, which of course requires every single stakeholder to join.
