It’s okay
They can apply for another petition for unused time on h1b
D1 - Thanks for letting me know. My current firm is filing Perm but I have this dilemma of h1b transfer being approved with other firm. The new job offer has a nice jump in terms of salary and compensation. Any thoughts on whether to stick or take the new offer?
OP: by how much time do you think filing the perm later (iff they agree, with the new employer) would set you back?
Also could you please summarize the process for h1 transfer? I am planning to switch as well so need to know more details. TIA!
OP:
Is it on the lines of:
1. New employer initiates transfer
2. RFE (yes, that’s a default now)
3. Approval
4. Resign and join new company
Alternatively
1-2 as above
3. Rejected - in this case does this invalidate the current visa?
Will be helpful if someone can provide tentative timelines for each of the step as well.
H1B transfer got approved with new employer but with 6 months less validity (~ 1.8 years to be precise). The current firm petition is valid for 2.2 years and now they are in process of initiating perm. Here are my queries:
1) Assuming it might take another 2-3 months to start perm process with new firm, is it risky to start perm process with just 1.5 years left on H1B?
2) Also, my current tenure at existing employer is of just 4 months. Is it advisable to leave the current firm for more money (~ 30% jump and one level higher at M level). The existing firm has shown enough trust to make sure visa process is taken care of. I am in dilemma as it would be leaving current firm in such a short span of time.
4) Is there a way I can negotiate with my current employer about salary or level?
