NDA or no, don’t talk bad about your old agency publicly unless you want to burn a bridge to the entire industry. While the vengeance will feel good, face the reality that it’s not going to change the bad agency one bit. It will be just used against you when a potential new agency looks you up.
I’m a woman and POC. I was reporting incidents to HR and they basically retaliated against me and here I am, resigned because I won’t tolerate their way of treating “others not like them” (their words). So yeah pretty tired of them getting the upper hand and silencing anyone that doesn’t fit their mold
If you have a lawyer, I would listen to their advice. Theyll know if the “shady ways of dealing” are legally shady enough to be worth your legal fees in fighting them. Sometimes the ROI for such battles isn’t that great. And I’m not just talking payout, I’m talking the blowback you’ll get from the industry in general.
Get as much money as you can, extend your health insurance, and use that NDA as a bargaining chip. You speaking out more than likely won’t change anything, and you need to take care of yourself. With cold, hard cash.

I just went through something similar and my lawyer was able to get them to nearly double my severance and keep me on their health insurance (at no cost to me) for the remainder of the year. Plus they agreed to allow me to show examples of work I did which had been a sticking point for my portfolio. LMK and I can put u in touch.
IMHO Nothing to be gained from being vocal in this industry. Wish it were different. Take the cash and move on. I was in a tricky situation recently and the company played hardball and didn’t even offer cash. I just struck them from my memory and left.

I went through something like this. Listen to your lawyer's advice. If the agency wants to settle quickly, they'll be willing to give you a nice settlement - it may mean going to arbitration not court. It could be a years worth of salary or more, depending on how egregious their actions were and how much evidence you have. Second, if you still want to work in the industry, it probably is best to not speak about them vocally, although I admire you wanting to do so.
Only your attorney can advise if you have a case worth pursuing (with enough evidence to make the agency take it seriously). If so, THAT’S your bargaining chip and will get you a proper settlement once you file. Right now they are testing you to see how little they can pay you to go away. Only your attorney can tell you if you have enough evidence to prove it was/is a hostile environment and get a proper settlement if you file suit. Such a suit may also be the best (maybe only) way to expose it all and “fix” the place so future employees don’t go through what you did. (Assuming you don’t let them buy your silence with the settlement.) The evidence you have is really the only thing that determines what you can demand from them, now or later. Caveats: not a lawyer; am rooting for you.
I'm sorry you're going through this now. But reading this thread you see how many people in this horrible industry go through it. Which means that just about every single company is shady. You don't need to be vocal about their shady ways...we all know. You're lucky that you can negotiate for more money or health insurance, etc. Most of us had to just walk away with our own morals and ethics in tact. Take care of yourself and your family, which means ensuring that you can find your next job. Because even if your vocalness means someone might end up on 60 minutes or in prison, you probably won't have a next job.
