I haven’t personally experienced this, but I have seen it happen to others with larger layoffs. As long as the company can justify the decision was not based on the leave (i.e. something like closing a location) I think they do it.
It’s not super common but I’ve seen it when the role is eliminated entirely within the org…usually comes with a beefed up severance agreement though
It happened to me. My surgeon wanted me to take an additional 2 weeks off beyond the FMLA window and HR told me that if I didn't return I would have a job but not the same position. I took the 2 weeks because my health is more important and when I returned, they still hadn't found a replacement but expected me to do the job. When I told them I would do the job as long as they put me back into the role, I was told I was being insubordinate. In the end, I was returned to my position, the manager was replaced, the HR person was relocated, for being unethical and making unsound decisions.
I have seen it happen, company is responsible for trying to place tge stuff in a comparable position unless tge role was,eliminates, then there is severance/separation agreement.
