Here's the deal - if you get the job, it will be because the recruiter did their job by finding you. Even if you get away with it, it's unethical as fuck. I'm no fan of recruiters, but they deserve to be paid when they do their jobs just like anyone else. If you don't like the pay offer, negotiate through the recruiter.
If you've already gone through a recruiter, the company can't hire you without paying that recruiter their fee. You're stuck with the recruiter.
Why do you think the job will pay better if you apply directly?
You talked to the recruiter. So even though you told them no, they can still claim their fee.
Because then they don't have to pay the recruiters fee. The recruiter offered 35 an hour for a mid level copywriter contract and I feel like in this area the mid level rate for a solid candidate is 40+

Did you try telling the recruiter what you want to be paid? They usually can get you more if they are willing to cut their fee to make the fill.

SP1: don’t think that’s true. However, if you take the job the recruiter previously reached out to you about you’re pretty much severing ties with them in the future.
If it was just an email and you told them no thanks, I’d apply anyway. You didn’t sign anything so there’s no binding agreement.
Sorry, but it doesn’t work like that most of the time these days, except maybe at Super small agencies that can’t really afford recruiters. Salary bands are set before the recruiters (internal or external) are involved. It isn’t like they are going to suddenly up the first year by 25% because they don’t have to pay a finders fee. That said if this was one of those shady email/LinkedIn spam firms that scrape postings from the web and try to rep you, yeah, fuck em.
Seriously, have any of you even worked with recruiters before? It’s not about the employers increasing the salary band by 25%. Of course that isn’t going to happen. It’s about the recruiter not TAKING OUT 25%. If you bypass said recruiter, you get to keep the full salary. Another way to do this is as Senior PM said, tell the recruiter EXACTLY what you are looking for. They will more than likely low ball you. (To fit in their percentage) but don’t budge. Also when dealing with recruiters ethics go out the window. They’re barely a notch above car salesmen.
