I have recently discovered that my former employer (right after I was let go), shorted their part of their contribution to my 401K. I checked and the state I am in has no statue that would help me. Federal laws are no help either, based on the way they set up the 401K and they picked the cheapest fund manager they could find for the fund. Any suggestions.

How much are we talking about? Is there any vesting requirement that would have prevented you from getting the match anyway? You can always sue in small claims court or ask an attorney to send a threatening letter. As for the fund manager sucking, you should be able to transfer the funds to an IRA with whatever brokerage you choose.

Thank you no in this case they were suppose to rollover unused PTO into my 401K they only rolled over 2/3 of the dollars and they sent me email stating no more contributions to my 401K. I am not sure small claims court can handle something like this. And yes I rolled over the funds to my personal funds manager. But it took weeks, because every time we called their fund manager we got a different answer or another excuse.

Considering joining a small 50-person company as the only attorney (prior attorney is retiring). (I am currently in-house at a F50). For others who have done the same path, what surprises did you have when moving from a large company to a small one?
