That is horrible. I would be more n HR’s office finding out why this is even a reportable offense and what bases they/had for an investigation in the first place. This is unacceptable.
Sounds like retaliation bc of the complaint you made about the treatment. I would get your doctor to fill out fmla paperwork in case you have another medical situation. CYA and look for another role. Seems to be a toxic work environment.
Do not sign anything without speaking to an attorney who represent plaintiffs in employment cases.
Rising Star
^^ very important advice here
Rising Star
What would I do? File a lawsuit
Sue. Unlawful retaliation. Contact a plaintiff employee attorney.
I do suggest going to HR and filing a complaint, but always remember that HR is there to protect the company, not you. Before making that move, I would reach out to an advocacy group. Get their advice, and make sure you collect any evidence you have and save it somewhere work doesn't have access. Sign nothing without speaking to a lawyer first and be careful about anything you say in a meeting, whether or not they tell you it is on the record.
Yes. I already had a title 7 civil rights claim against them based on gender, race , color and nationality origin over a year in EEOC. They were confident that it was tough to prove. I was let go like a normal lay off. I had a status change, my manager who did not care about me a bit for 5 years did not not disclose my medical condition to EEOC. I was undergoing infertility treatment while they fired me in July. The company came to know about my current situation with EEOC, so the company doubled the severance. I obviously did not take the severance. EEOC is investigating the case. The company makes a profit of more than $40 Billion per year. I’m just nothing compared to that giant company which has forced arbitration in place. I’m just worried about how my current employer will deal with it, if they know the situation. I have not disclosed my pregnancy yet to my new company. I’m worried I’ll be seen as a trouble maker by new company. Between infertility is a disability under ADA.
Contact an employment attorney immediately and don’t speak about it to anyone but the attorney until you have advice on how to proceed.
Oh no, I'm sorry about that. What did that process look like? Was this your first time asking for something like that?
Yes, in the 5 years of employment I asked that for very first time, I had a recent medical condition. All my colleagues including my manger are white males. I was the only colored person and only female. I already had an ongoing dispute about my treatment. I’m not sure how can this be entertained as valid complaint. I was investigated and eventually cleared of any wrongdoing. What would you do if you were in my position?
that sounds so weird. Why would they investigate that? Do you have excessive absences? If not, what did they advise you after they investigated? Who investigated this? Sounds like maybe you should speak with someone from HR or the union if you have one.
The company has hotline investigation. This is other than HE services. I can’t reveal more because I’d have to identify the company.
Investigated how? Did they keep you from going back to work longer than the time you requested off? That's so odd.
Is this ordeal the arbitration? If the arbitration is for another legal claim then your ordeal about menstrual should be free. It’s not talk about a lot and there is no precedent for it. It is in the grey area. The report/investigation about the menstrual sick can be consider retaliation for the other claim. Are you going through arbitration for discrimination via eeoc? I would have hire a lawyer and sue for discrimination much bigger impact to the company and it will force them to change.
To give more info. All my colleagues including my manger are white males. I was the only colored person and only female. I already had an ongoing dispute about my treatment. I’m not sure how can this be entertained as valid complaint. I was investigated and eventually cleared of any wrongdoing I then reported this to company’s senior counsel which was more of closed door discussions. His response was - ‘why would you talk to your male manger about your period?’ I want to sue them mainly for this but the company has forced arbitration in place. Is there any tips how to deal with this?
I was not barred from doing any work. I slacked(app) my manager asking for permission and usually he never gets back. I said I’ll be back in 1.5 hours after resting. He never responded to me, I took the break. After a week I had a meeting setup with that legal team and I thought it was for ongoing dispute. To my surprise I was investigated for this. I’m an immigrant , lawful permanent resident and I’m understanding the laws. I’m out of the company now and I started employment with another major corporation recently. If I go public with story how will I my future legal claims be affected? Will my current employer have a problem? The company is trying to force arbitration and keep this ordeal In private. This is just one drop of entire situation. The other thing I can reveal is company is a major DEI advocate but definitely no one protected me.
