This was answered by the google layoffs- yes they can do it. They can’t include you in a layoff because you’re pregnant, BUT if your performance includes you in a mass layoff, your pregnancy can’t save you. Example: you fall in 20% of lowest performers at work and the company is cutting the lowest 20%. You can be laid off. However, if you do not fit the layoff qualification and they lay you off, you have grounds to argue it was because of your pregnancy.
Please remember you do NOT have to disclose your pregnancy to ANYONE during the hiring process. It’s illegal for them to discriminate against you in the hiring process, but I’ve never disclosed and encourage all my friends to not disclose. Once you’re hired in (documents signed and you’ve finished any new hire period) you can call up HR and tell them. You’re not required to tell your management as long as HR was informed.
I disclosed that my wife is pregnant in early stage and from that day oneard, manager tone was changed. She was constantly asking me when I am going for leave and what are my plans? At that point I felt, I shouldn’t have disclosed early. Then on December company started laying off by providing voluntary layoff package. Just few days before deadline she scheduled call and told that I underperformed. It was shocking for me, since week back we had 1:1 and she told me that I was doing better at work. The reason for underperformance was just because, I screw in using filter while building dashboard in Tableau and she told me to take voluntary layoff package.
So, I would suggest to let them know later.
I haven’t been laid off but could not work 75+ hours per week on a burner case (during first trimester) and got my worst review since starting because of it. You can absolutely get fired, and there are plenty of ways they can fire you whether performance related or not. We’re at will employees. Pregnancy discrimination is not okay or legal, but is also incredibly challenging to prove. Take care of yourself by getting on short term disability or reasonable accommodation if you need it, but don’t expect pregnancy to save you from termination. That said, it also 100% shouldn’t impact your ability to get a new role, and don’t feel compelled to share it when you’re interviewing.
Which country are you from? I assume US. Generally in Europe you cannot get fired. Though if a person gets fired one gets 60% of the salary in Germany for 6 months, while on parental leave you get almost minimum wage… for working professionals, the business case is better to get fired than to be on leave - yeah it is ironic

Risky. I thought it was illegal to lay someone off bec if pregnancy. If it is, mentioning you’re pregnancy may be the smarter move. Lawyer up

Unfortunately, I was laid off when I was 5 months pregnant, and I am currently taking a break, despite my confidence in my abilities in clearing interviews, I feel this is the best course of action for me right now. I did inform my manager orally of my situation when I was 3 months pregnant as I had some complications, but I realize now that it would be better to follow up with a written communication to provide proof of the conversation.
