Kind of getting sick of experts who back off their opinions come trial because they don’t want to go on the record with an opinion in order to protect themselves from being challenged in future cases. WTH?

Don’t know what area of law you’re doing but I used to pick people who didn’t advertise themselves as experts. People who were just good at what they did and didn’t do expert witness work usually

I’ve found this to be a double edged sword. The experts who aren’t professional witnesses that I’ve worked with have a harder time understanding the case and where they can concede points without completely crumbling on cross examination.

I impeached my own expert witness once. Thankfully I had a deposition transcript with exactly what I needed her to say and was able to convince the jury the deposition transcript was correct and she was trying to back off at trial for nefarious reasons.

This is wild. I can't imagine how stressful and uncomfortable that was.

It happens. I never ever ever use them again.

Does your firm give you credit for hours that were written off? Sometimes I feel if you don’t lose anything for hours cut from the bill, you have incentives not to be 100% honest w/ your timesheet.

I was at the top of the class in law school and got the highest grade in lots of courses. Ran the law review, order of the coif, etc. But I haven’t felt “smart” since then - it has been several years as an associate now and I feel like I haven’t “gotten it” yet. Not sure if this is normal, or if the occasional passive aggressive comments from partners are building up, or if I am just lame. Anyone else feel like this?
