I've never let anything go to suspension. I would prefer to resign so I never have to explain it if they ever check.
NJ lawyer here. Better to resign without prejudice than go into administrative ineligibility. Administrative ineligible status lawyers are still subject to NJ ethics jurisdiction. Likely easier to reapply after resignation without prejudice than if you are administratively revoked after 7 years of administrative ineligibility. You might actually have to pay all those back years to bring yourself “current” in dues in order to get readmitted if you do administrative ineligibility to administrative revocation.
Former NJ lawyer here- my firm only pays for 1 license and I don't plan to practice in NJ, so I administratively resigned. Super easy process. There is a form on the website. If I'm remembering correctly, the only annoying part is that you have to get it notarized.
Have you discussed with your current firm if there’s any benefit for you keeping that license? Overall, I understand your frustrations, but I found that the more places I’m licensed the better edge I have over competition. I guess it depends how long you want to stay at your current firm.
Oh, sorry. In my head for some reason, I just assumed you were in New York. No if you’re going to California being licensed in New Jersey doesn’t make a lot of sense.
If you ever want to waive into another state bar, would letting it go to suspension come up in the process and harm your chances of acceptance? And could the suspension be reported to your current state bar and possibly cause a problem?
Resign. NJ is a pain you don’t want a suspension
