Ok someone please help with this. We have a patient who is threatening to sue the facility due to what is difficult to prove as malpractice and I don't think they have a case, but I'm not sure. Should we let it get to that point or try to settle it with them another way and what do you suggest? I know the doctor to be an excellent physician and we've had complaints from the patient before so I don't want to put our physician at undue risk including reputation but also need to be ethical.

Consult legal before doing anything. You do not want to put yourself or the physician in a compromising situation that will be hard to bounce back from or get out of.

Let a lawyer figure out exactly what it amounts to. Don't offer pt. restitution of any kind and then send him away. He will be back and it will be harder for you to explain why you offered restitution - are you guilty and you know it??? Let a legal person look at the entire picture and see what you're dealing with so that he/she can instruct you on the proper way to handle this. In the meantime, don't let pt. keep coming in with his complaints or calling the clinic and asking what is being done. And the treating physician has the right to "fire" this patient and inform him that he needs to find a new GP.
