Seeking advice. I’m a counsel making a push for partnership. I recently got a big lead. My contact is a personal friend and is trying to get us a deal. We are organizing a lunch next month with her boss and the head of my group is joining. I want to have a discussion with him on origination credit or just something that can be recorded for my push for partnership. I’ve heard that counsel don’t really get origination credit so want to get some thoughts on my options here. Thanks in advance!

Do you have an assistant? When I open matters I am assigned origination credit and client relationship credit. Just have your assistant open the matter with those credits assigned to you. Try to get an understanding for how all of this works before you have that meeting. If the head of the group opens the matter you are likely screwed

Complicated, and driven by relationship and personality. If you can close the deal without your boss, then you have a clear 100% origination. If you need them there, then you don't deserve 100% origination; you don't have what it takes to close it alone.

Since you've invited them in before closing, they could either (a) be very generous and supportive and not ask for credit, or (b) according to their personality and view of either, either take the whole ship or do a 50/50 split, or something else. It's culture, relationships, and personality at that point.

When I was in your shoes, I tended only to invite partners who were very supportive of me growing my own book, and realized they were just there to seal the deal, but not for much more than that.

Was interviewing with a firm and soon after receiving an offer, learned of bad culture/toxic partners in the practice group from a couple of associates who recently lateraled from the firm. I turned the offer down. A partner that I clicked with while interviewing reached out asking me why I turned down the offer. Should I be honest and relay what I heard?

To the lender counsel that forgot to mention they needed original signature pages for a deal that closed early this year and decided to chase and harass me a day before thanksgiving and a day after thanksgiving multiple times. F*ck you. I don’t know what is driving your lack of courtesy but I have represented the same bank before and know their usual original signature requirement.

PSA - We are headed into a self-imposed economic slow down. Now is not the time to lateral but if you do, I would make sure you are at a recession-proof practice or firm. The top law firms will be okay (they always are) but if you are part of a larger group of associates with no work, you are likely to be axed. Latham did it in the 2008 and 2011 and it will happen again. If you are an associate or really anyone but a rainmaker, you are expendable.
