If there were any conceivable claim, it would be an extortion claim against the administration a la the extortion claims brought against Michael Avenatti in connection with the settlement offer he presented to Nike.
There can be a fine line between a settlement offer and extortion. But generally nobody is prosecuted for making a settlement offer (unless they’re a political opponent of the administration like Avenatti was). As a general rule, we don’t want to be imprisoning people for making settlement offers. If the claims are meritless, the appropriate response is to reject the settlement offer and defeat the claims in court. Not to make a criminal referral for extortion.
Hence “lol” at the notion the firms could be liable. If anyone could be liable, it’s the administration, but they will not be prosecuting themselves for extortion.
